These Terms of Service ("Terms") form a binding agreement between you ("you", "the Trader") and IndieFunded ("IndieFunded", "we", "us"). By creating an account, purchasing an evaluation, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. Nature of the service
IndieFunded provides a skill-assessment and simulated trading service for traders of NSE index options. Our evaluations and funded accounts operate on simulated capital in a live-market data environment.
- We are not a stock broker, exchange, depository, portfolio manager, or investment adviser, and we are not registered with SEBI in any such capacity.
- Account sizes (e.g. ₹50,000 to ₹10,00,000) refer to simulated capital allocated for evaluation and performance purposes. No real funds are deposited by you into a trading account, and we do not hold client money for trading.
- You are purchasing access to an evaluation and the opportunity to earn a performance-based reward, not a financial product or guaranteed income.
2. Eligibility
- You must be at least 18 years of age and legally able to enter into a contract.
- You must not be located in, or a resident of, any jurisdiction where participation would be unlawful, and you are responsible for ensuring your use complies with your local laws.
- You must provide accurate registration information and keep your account credentials secure. You are responsible for all activity under your account.
3. Evaluation rules
To pass an evaluation and qualify for a funded account, you must satisfy the trading objectives published on our website and dashboard, which currently include:
- Profit target: 6% of the account's starting balance.
- Trailing maximum drawdown (EOD): 3%, measured end-of-day against your highest achieved end-of-day balance.
- Daily loss limit: none.
- Consistency: no single trading day may account for more than 40% of total profit.
Permitted instruments and product types (NSE index options on MIS and NRML) and any other parameters are as displayed in your dashboard. We may adjust rules for new purchases; the rules applicable to your account are those in effect at the time of purchase, except where changes are required for risk, compliance, or platform integrity.
4. Prohibited conduct
The following are strictly prohibited and may result in suspension or termination of your account and forfeiture of any rewards or fees:
- Exploiting errors, latency, off-market or stale prices, or platform bugs.
- Trading techniques designed to abuse the simulated environment, including but not limited to high-frequency or latency arbitrage, coordinated group trading, copy trading across accounts, hedging between accounts, and use of prohibited bots or automation.
- Using another person's identity, or operating undisclosed multiple accounts to circumvent rules.
- Money laundering, fraud, chargeback abuse, or any unlawful activity.
5. Fees and payments
- Evaluation fees are one-time charges based on the account size you select, as displayed at checkout (exclusive of any applicable taxes unless stated otherwise).
- Fees are payable in Indian Rupees through our authorised payment partners.
- Refunds, where available, are governed by our Refund Policy.
6. Funded accounts and rewards
Upon passing an evaluation, you may be offered a funded account on the terms communicated to you. Any profit share or reward is calculated on simulated performance, is subject to the rules and payout conditions in effect, and may require identity verification before payout. We reserve the right to withhold or adjust rewards obtained through breach of these Terms.
7. Intellectual property
The IndieFunded platform, branding, content, and software are owned by us or our licensors and are protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the platform for its intended purpose. You may not copy, reverse-engineer, or resell any part of the service.
8. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind. We do not warrant uninterrupted or error-free operation, and we are not responsible for losses arising from market data delays, connectivity issues, or third-party outages. Nothing on the platform constitutes financial, investment, tax, or legal advice. Please review our Risk Disclosure.
9. Limitation of liability
To the maximum extent permitted by law, IndieFunded and its officers, employees, and partners shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or data. Our aggregate liability for any claim relating to the service shall not exceed the total fees you paid to us in the three months preceding the event giving rise to the claim.
10. Suspension and termination
We may suspend or terminate your access at any time for breach of these Terms, suspected fraud or abuse, or where required by law. You may stop using the service at any time. Provisions that by their nature should survive termination will continue to apply.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the website or your dashboard. Your continued use after changes take effect constitutes acceptance of the revised Terms.
12. Governing law and disputes
These Terms are governed by the laws of India. Subject to any mandatory consumer protections, the courts at our registered place of business shall have exclusive jurisdiction over any disputes.
