1. Acceptance of these terms

These Terms & Conditions ("Terms") form a binding agreement between you ("you", "the trader") and IndieFunded ("IndieFunded", "we", "us") governing your access to and use of our website, trader dashboard, evaluations and simulated funded accounts (together, the "Services").

By creating an account, purchasing a product, or otherwise using the Services, you confirm that you have read, understood and agree to be bound by these Terms and by any rules referenced within them, including our trading rules, Privacy Policy, Refund Policy, Cookie Policy and Risk Disclosure.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract in your jurisdiction to use the Services.

You are responsible for ensuring that your use of the Services is lawful in your country of residence. We may decline to provide the Services to any person or in any jurisdiction at our discretion.

3. Nature of the Services (simulated)

IndieFunded provides an evaluation of trading skill and simulated funded accounts. All trading conducted through the Services takes place in a simulated environment using market data. No real capital is deposited into any trading account you use, no orders are routed to any exchange, and no securities are bought or sold on your behalf.

IndieFunded is not a stockbroker, exchange, clearing member, portfolio manager, research analyst or investment adviser, and does not solicit or accept funds for the purpose of trading real securities. Fees paid to IndieFunded are for access to the evaluation programme and simulated funded accounts, not for the deposit of trading capital.

4. Account fees, pricing & coupons

Access to an evaluation or Instant account requires a one-time fee, shown at checkout in Indian Rupees. Prices, account sizes and objectives displayed on the website are indicative and may change at any time before purchase.

Discount codes and promotional offers are subject to their own terms, may be limited in time or quantity, cannot be combined unless stated, and may be withdrawn or modified at any time. The discount applied depends on the account size selected, as described in the offer.

You are responsible for any taxes applicable to your purchase. Completing checkout constitutes your agreement to the fee for the selected product.

5. Evaluations & funded accounts

Instant, 1-Step and 2-Step accounts are subject to the trading objectives, loss limits, minimum trading days and other rules published on our Rules page and within the trader dashboard, as updated from time to time.

Meeting the objectives of an evaluation entitles you to a simulated funded account. Reaching a simulated funded account does not create any right to real capital, employment, partnership or agency with IndieFunded.

We may modify account objectives and parameters for new purchases. Material changes to an active account's rules will be communicated where reasonably practicable.

6. Rewards

Rewards are payments made by IndieFunded to eligible traders calculated as a share of the simulated profit generated on a funded account, subject to the applicable profit split, reward cycle, minimum trading days and, for Instant accounts, consistency conditions.

We may withhold, adjust or reverse a reward where an account breaches these Terms, the trading rules, or where prohibited trading practices are detected. All rewards are subject to verification prior to processing.

7. Prohibited conduct

You agree not to engage in any practice that seeks to exploit the simulated environment rather than genuine market opportunity. Prohibited practices include, without limitation:

• Exploiting latency, off-market, stale or manifest-error pricing in the simulated feed.
• Coordinated, group or copy trading across accounts, or hedging opposite positions between accounts or with third parties.
• Abuse of execution around major economic or expiry events, including trading within any restricted window that applies to your account.
• Any use of automation, manipulation or fraud intended to produce results not reflective of legitimate trading skill.

Breach of this section may result in immediate termination of your accounts, forfeiture of rewards and denial of future access, without refund.

8. Intellectual property

All content, trademarks, software, and materials made available through the Services are owned by IndieFunded or its licensors and are protected by applicable laws. You are granted a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose. You may not copy, resell, reverse engineer or create derivative works from any part of the Services without our written consent.

9. Disclaimers & limitation of liability

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free or free from delays in market data.

Nothing on the website or within the Services constitutes financial, investment, tax or legal advice, or a recommendation to trade any real security. To the maximum extent permitted by law, IndieFunded shall not be liable for any indirect, incidental, special or consequential loss, or any loss of profits, arising from your use of the Services. Our aggregate liability shall not exceed the fees you paid for the product giving rise to the claim.

10. Suspension & termination

We may suspend or terminate your access to the Services at any time for breach of these Terms, suspected fraud or prohibited conduct, or where required by law. You may stop using the Services at any time. Provisions which by their nature should survive termination will continue to apply.

11. Governing law & disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts at the seat of IndieFunded shall have exclusive jurisdiction over any dispute arising out of or in connection with the Services.

12. Changes to these terms

We may update these Terms from time to time. The version published on this page is the current version, and your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
